    Threatened With Eviction Over Carpet Damage
    My question involves landlord-tenant law in the State of: NC

    Landlord did not require that I pay a security deposit or a pet deposit at lease signing. My friends dog dug a foot long hole in the living room carpet down to the subfloor. I was willing to have her repair the damage which she agreed to do... Landlord is bitter because I will not sleep with him and I received a letter now, demanding that I replace the entire LR carpet and pad with expensive carpet before Thanksgiving (because he's coming to inspect it!!!) OR he will start the eviction proceedings. Now my lease is up at the end of April 2014 and I have a child and a dog....so why in the heck should I replace the ENTIRE old carpet which he did not shampoo prior to my moving in BEFORE my last month as a tenant. (what if it gets damaged again?) And if he didnt require a security deposit nor a pet deposit, why is he bothering me about it at all...

    Am I required to replace the entire OLD carpet or even repair the footlong hole? Now my lease does have a Repair/Replacement clause that said something about negligent damage caused by me or any guest. Doesnt that refer to the security deposit though?

    But isnt a repair enough??? or cant he just buy the carpet/pad for the entire LR and just charge me for the square foot of damage? AND can he actually evict me for carpet damage???

    He's asking that you replace the carpet because your dog damaged it. If your dog damages it again, I expect that he'll ask you to replace it again.

    You should respond that you're only responsible for the depreciated value of the carpet. (Age of the Carpet / Life Expectancy of the Carpet * Value of Comparable Replacement Carpet).

    Odds are a repair would not be cosmetically acceptable. If you can manage to repair the carpet and pad such that the damage is not noticeable, that should be an acceptable solution.
