Can Federal Employees Ignore "No Trespass" Directives From Property Owners
We frequently have employees from The Bureau of Labor Statistics approach our apartment building, looking to get info on some of our residents. Typically, we deny them entry and never provide them with any resident information, despite their tactics of intimidation and bullying. If they can't reach the resident via of the intercom, they're out of luck. Barring a court order, I believe we're under no legal/lawful obligation to give them anything.

Recently, one such federal employee said she was merely being courteous by asking to enter the building. She said that, by law, she and all federal employees are above all "no trespass" laws and can enter onto any property and there's nothing a property owner can do about it.

Is that true? Can they just trespass all over the place, even on private land? Can't I tell them they're trespassing and insist that they leave?

    Thanks.

She's full of crap. Ask her if she's heard of the fourth amendment. It most certainly does not extend to all federal employees. Census takers (for the Constitutional federal census) are given a bit of latitude under the statues but BLS canvassers? Tell her to take a hike.

    Why?

They always say they can't tell us the "why" of their visit. Just data-mining and stat-taking, if you ask me. That department, I don't think, investigates abuse of unemployment-related benefits or anything. I think it's merely an information-collecting entity. I know there are a couple of residents currently on unemployment, and I'm guessing these fed employees are trying to compile info for quarterly state/national stat releases. Who knows?

I understand they're simply trying to do their job, but I hate it when they outright lie and try to bully our managers into getting what they want. Incidentally, nearly every such fed employee I've come across over the years dresses like a total slob. Apparently, there's no dress code in place to require them to look halfway presentable to the general public.

Unless they have a warrant they have no more (or fewer) rights than any member of the public.

Actually, if they were doing an investigation they have less right to enter. Census workers get a pass because the importance of the census has been determined to out weigh the individual privacy right. A federal investigator would have to get a warrant.
