    Failure to Appear for a Random Drug Screen
    My question involves criminal law for the state of: Ohio

    Case



    I am on probation for 1 year for DUI with 177 days suspended. I have been compliant with probation thus far. I work full time and I am an active member of my community via the local JAYCEEs. I failed to show up for a random drug screen and now I have a bench warrant for my arrest. I know I must turn myself, I am trying find the best case to present before doing so.

    Three Questions:
    What are my chances of Staying out of Jail?
    Should I involve my lawyer?
    How should I approach

    A warrant was issued for your arrest. Usually a bond is set for your release. In some instances, no bond is issued but one may be set a a bond hearing scheduled at a later date.

    No you haven't. You failed to drop. Now it's a matter of whether or not your PO has other instances of noncompliance to report. If you are behind on fees, if you haven't enrolled in treatment. If you missed some reporting dates. Ultimately, your failure to drop and having a warraint issued is huge.

    That could actually work against you as well. It could indicate that you are not taking your obligation to your court conditions seriously and that you'd rather take care of your "normal," day to day business rather that your court mandates.

    All in all, you need an attorney and let him/her take the lead. You'll do yourself more harm than good.

    Oh yeah, be prepared to have to sit. A lot of counties consider a missed random a dirty random because it gives the impression that you are hiding something. Also, you may have to drop instanter to prove that you are not using when you go to take care of this warrant.
