I Pay Child Support But My Children Do Not Live with the Custodian

My question involves child support in the State of: Missouri. I have two questions. I have two children that I am paying child support for, ages 15 & 17. I recently found out from my 17 year old son his mother kicked him out. He has not lived with his mother for over a month. Also my 15 year old son has been in the custody of DYS for about a month. I have no problem paying child support but if they do not live with their mother is she still entitled to continue to receive their child support? Also she reported to child support enforcement that I did not pay from January to May of 2013.So now I have to pay back child support. From January to May 2013 my 15 year old was living with me and we had a phone conference with a child support officer and the mother agreed to stop payment because one child lived with me and one child lived with her. What can I do about the back child support I do not owe?

I have to assume you are not making payments to the friend of the court who would forward them to the mother. Bad move.

I guess mom changed her mind before she went to have the order modified and since you didn't do anything about it either, you owe the child support.

You can file to modify the support order as well as seeking custody of your children.

I do pay the child support and the back child support. It is taken from my check weekly. And with the recorded conference with the child support enforcement officer with our agreement isn't that proof I don't owe back child support?

Also the mother is remarried and still using my last name to receive state aid (food stamps) and claiming her husband does not live with her for extra benefits. She also has her own freelance business as a make up artist. I have proof of everything she has been lying to the state about. Do I turn her in?

No. Showing an modified order dating to that time would prove you do not owe the child support. Until the court makes it official, it is only talk.

would you turn her in if she was your neighbor and not the mother of your children? If so, then turn her in. If not, then don't since it is simply to be vindictive.

So if I have the paperwork from the officer we had the conference with stating that we came to that agreement is that enough proof for court?

You said nothing about any paperwork before. He was a witness on the phone from what you said.

So, exactly what paperwork do you have from the child support officer regarding this issue?

I have a letter from the child support agency stating that it was agreed by both mother and father that no child support is to be paid

Future child support cannot be waived in this manner.

If the support order was changed, then the new support order governs support. If not, then not. I have no problem paying for my children ive never not paid and always gave extra for school supplies sports school clothes ect. Even when she wouldn't let me always have my weekends with my kids I've aleays paid in cash and thst was my mistake I have no proof of payment just her word and (due to my 2weeks long delay in a paycheck from changing employers because my previous one did not pay me for a month) she got mad at me because I told her I didn't have any money for her until the next week. And that's when I started getting child support taken from my paycheck every week. I don't no any other reason why she would have done this to me. And the sad thing is she doesn't get as much as through the state as she was getting from me and my fiance. My kids needed thier teeth fixed badly and their mother wouldn't take them because she said their insurance only had dentists from the city . So my fiance spent her income tax money to fix one sons front teeth that was knocked out she paid to have it replaced and my other sons top four front teeth were starting to rott and my fiance took him and paid for four fillings. She doesn't care about our kids anymore she has two girls with her husband. If my kids were living with her I'd have no problem but I never hear from her she doesn't answer my calls I talk to both of my sons and want them both to live with me. I only have a problem with the back support she lied about. Thanks for your help and information.
