Abruptly Kicked Out of a Rental
My question involves civil rights in the State of: Oregon
I will try to make this short. I moved with my partner to Portland OR to his cousins house. After two months they turned out to be somewhat psycho. There were no confrontations leading up to this, only that we were told every couple days our rent was going up for staying in there garage (no lease was signed)
The woman who owns the house came into our room and told us we needed to get up before her husband got home at 7:30am or we were going to suffer. We told her we were getting up and she began to yell and tell us we needed to get up when we were told and grabbed my boyfriend by the shirt. He told me to call 911 and her brother came in to our room and threw me across our bed onto our concrete floor calling me a fag. While I was being thrown around, my boyfriend was arguing with the woman of the house and she grabbed our ipad and ran to her room. I went for my cell phone on our bedside table and was again thrown on the floor and my cell phone was taken by the womans brother. We ran out of the house with none of our stuff to begin the mile walk to get to a phone. While walking the womans husband ran down the sidewalk yelling that we were fags and he was going to kill us. After calling the police they said they had already been dispatched to the house. The officer showed up to our location about 45 mins later and took our side of the story. He said the woman told him we had assaulted her and that we should not file charges against her brother for throwing me across the room because the judge would just throw everything out. We returned to the house with the officer and were told we could grab what we could carry (we did not have a car at the time) and come back at a later time. The woman and her husband had packed our belongings in garbage bags, taken apart our bed, and told the officer we had only been there a week (we had lived there two months). He said we were technically residents by Oregon law. While we were packing our things the husband and wife were yelling at us that we were fags, and other names I cant put on here. I asked the officer if he could do anything and he shrugged and said no.
Over the next few days we tried to return to get our stuff, we were told if we wanted our stuff back we would have to sign a piece of paper saying we would pay her a random amount of money and that she had no idea where our ipad was. When we refused to sign a piece of paper (I believe this is extortion) she threatened that she would tell the officer whatever was needed to press charges against my boyfriend for assault.
After now almost three weeks of trying to contact them to get our stuff we finally received a phone call from the wife. She said we could get our stuff on Monday but it had to be on her time, and if we showed up with a cop for protection or anyone she did not know, she would press charges as well as other threats, she was filing a restraining order against us, she was going to make our lives a living h**, and we would never get our stuff back.
Is there anything I can do? I'm honestly scared to go back without a police officer but if we do she has threatened us with false charges, keeping our things, ect. I do not have money to pay an attorney but any advice would be great.

    Disagreeable
    Re: Kicked Out,assaulted,call Homophobic Slurs
If this is strictly a homophobic hate crime, as you seem to be attempting to portray it, the story does not make sense. I suggest you start all over. If they were so homophobic, they would not have rented to you initially. One does not wake up with an epiphany of homophobia. Why don't you start at the real beginning, with the whole story. It does sound like you were the victim of an illegal landlord self eviction. No one here is going to judge your sexual preferences and will give it the same credence as the rest of your story.

    Quote:

I know the term is intended to be derogatory but isn't it true in it's basis? Fag, which is short for faggot, is simply defined as a male homosexual. Isn't that accurate?

generally a person does have freedom of speech that does allow for them to say what they want in a lot of situations. They may be jerks but they do have a right to be jerks.
I believe you are correct in not returning without a police standby.

If no charges were filed do to the incident, it is unlikely any would be filed now, regardless what she said.

so, you can either call the police and ask about them doing a standby
you can sue them (presuming small claims court would suffice) for anything you have not been allowed to pick up

going to have to check the landlord tenant laws to see if there is anything there for you. I would not expect much given you were living in an illegal situation and really should have known that it is.

    Re: Kicked Out,assaulted,call Homophobic Slurs
Thank you for the replies. There was no previous homophobia, they were supportive. I believe the homophobic slurs were just to hurt us personally as well as something I failed to mention was that we slowly came to realize the husband and wife had an issue with prescription drugs. We slowly started to notice when they ran out there moods would turn, which I believe this big blow out came from. But the threat that they would kill us and basically hold our personal belongings were out of line. Initially they thought I was going to file assault charges for being thrown around and we were told if we filed the charges they would make up whatever they needed to file charges against us. Then it was that we needed to sign a piece of paper if we wanted our stuff back saying we owed "x" amount of money (according to our verbal agreement we were paid in full but I have no proof). And now finally it is that we better not show up with a cop and that they never saw certain expensive belongings. It just seems wrong that people can hold belongings of mine unless I give into there commands.
