Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
I agree with Bubba, save for a small clarification: The police may already have enough information to make an arrest, and may be simply looking for self-incriminating statements or a confession in order to make it an easy case. They also may be wondering if the charge should be simple assault, or a more serious charge. I would still strongly recommend lawyer first, interview (if the lawyer agrees and attends) second.
Given that the essential facts don't seem to be in dispute, save perhaps for motive, there seems to to be probable cause that a crime was committed and that the suspect committed the crime. "It was a joke" is not a defense to battery. Here's the simple battery statute, for purposes of illustration:
Quote:
Quoting 720 ILCS 5/12-3. Battery.
(a) A person commits battery if he or she knowingly without legal justification by any means
(1) causes bodily harm to an individual or
(2) makes physical contact of an insulting or provoking nature with an individual.
(b) Sentence. Battery is a Class A misdemeanor.

Should assume that hostile = not what you want to hear?

I'm curious as to what Albert would be saying if Princess were on the receiving end of the hit. Would he still be trying to downplay it?
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
hostile is referring to the subject in question as "princess" or using all caps and yelling through your computer. I think its fairly obvious that here is hostility.
As it has been seen other forum members have been helpful.

cbg's comments have been helpful, even if you're too stubborn to see or admit it.

"I'm curious as to what Albert would be saying if Princess were on the receiving end of the hit. Would he still be trying to downplay it?"
....I'm a third party who know has just get sucked into an internet forum argument that didn't need to happen haha. this is nuts. why are you trying to antagonize me by calling her princess?
By calling her princess you have taken the little information you have and built this whole construct of an over privileged girl who is in the wrong. I don't know exactly what your purpose in this is....you have no idea the scope of the situation and again have little empathy....Again only looking for helpful legal advice as this is what the forum is for. which CBG has not given actually... not once.
in my purpose here I dont care if she was in the wrong or not....looking for legal advice. Empathy has nothing to do with the person being at fault or not it...its irrelevant how do you not understand that. We are all just people here haha wow. The internet can be so sad.

Alright, this thread should end right about...
...now.
Given that it's not your legal business to begin with.
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
Oh, yes, I'm definitely hostile to teens who think it's acceptable to send their peers to the emergency room. Who think it's a joke to assault them.
No question about that. Nor am I ashamed of it.
I'd still like to know what Albert would be saying if the other kid hit Princess with a binder and sent her to the ER. And it's your attitude towards her that's leading me to call her Princess. I don't know how entitled she thinks she is, but clearly you think she's entitled to commit assaults with no repercussions. For all I know she has no entitlement mentality at all, but she's obviously your Princess.
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
haha well what do you want from that question its totally irrelevant because its so loaded.
I'm a fairly unbias well meaning person. If a kid gave my kid a concussion lets say for fun...a minor one and they were fine I probably would not press charges. I don't think think throwing the book at anyone or any of this is of much help. They need maybe consoling ....but scaring them is not a good route that much I know.
In this case this kid deals with enough and has enough financial issues at a young age to deal with as well as is a great student with a bright future. scaring the shit out of her is not going to help her life. and even if she punched a kid in the face I would think the same...she needs help ...not to be yelled at or put in handcuffs.... but that isn't the case....this is not a violent kid...
I'm signing off of this internet argument now. I understand the demeanor on internet forums is often like this but it doesn't make it acceptable

We're in agreement there, mirror-man. Your conduct is unacceptable.
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
scaring the shit out of her is not going to help her life
Wrong. Scaring the shit out of her is exactly what she needs. It does no one any good to make excuses for her and let her get away with unacceptable behavior - that way she learns that there are no consequences for her actions and she can do anything she likes.
It's teaching kids that there are consequences that will move them onto the right path and not the wrong one. Since she clearly has not learned that lesson yet (if she had, she wouldn't be in this situation now), maybe scaring the shit out of her will do it.
With any luck it will only take a stern talking to at the police station and not a criminal record. No matter what Albert thinks of me, I don't like to think of any teen having to carry that around with them for the rest of her life. But if she does? She has no one to blame but herself.
