    It actually isn't me. Regardless yes, she will be accompanied by a parent. English is 2nd language though so there is some difficulty there.

    If charged can you explain what that day looks like for the student, how long can they hold her at the station? or will she even be for a crime of this level even if the peer did receive some kinda injury?

    NO. We CAN'T. There are a hundred variable factors that could affect the answer, and we don't know ANY of them.

    do you understand that a layman coming here does not understand that and as an expert on a forum you are generally here as a favor to people to help them?

    that was actually somewhat informative....if I was an expert maybe I would explain to someone the scale of possibilities from low to high in severity and try to actually help the person understand the situation.

    I DON'T HAVE A FREAKIN' IDEA HOW LONG THEY WILL HOLD HER AT THE STATION. I DON'T KNOW HOW BUSY THEY ARE OR WHAT ELSE WILL HAPPEN WHILE SHE'S THERE THAT TAKES PRIORITY OR ANYTHING ELSE ABOUT WHAT WILL BE GOING ON THERE.

    Do you understand a layman doesn't even know what variables are at play? Seriously I would just think about the way you are handling yourself. It's embarrassing and rude. There are better places, especially in the physical world to channel your anger or w/e your dealing with then on un informed layman.

    I have while posting here been doing some google searches and found a few things of help on IL assault and battery charges. I should have probably started there but I made my post frantically looking for help. Please have some empathy in the future and actually attempt to help rather then making self serving hurtful posts.


    I understand as layman yourself on human emotion you may not understand the word empathy. Here is a definition

    Hypothetically, The student should immediately get a lawyer to go with them to handle the police. If the students parent cannot afford to, the students parent should advise them to decline to make a potentially self incriminating statement to anyone, including the police officer. The parent should go with them to the police station, and act as intermediary, taking the heat for childs refusal to make a statement. The officer should be free to chew out the student, yell at the student, threaten the student and lie to the student. After the officer is done with all that, he will decide whether to charge the student. The parent and student, neither of whom have made any kind of statement referring to the incident, should then leave and get a lawyer to address any charges made. It should be noted, the parent is free to interject that they wish to take the child and leave at any time if the officer is not holding them in custody.

    As an aside. Tell your friend what she did was really, really, stupid. That child could have brain damage for the rest of their life. If they were not already suffering from a seizure disorder, her stupidity could have given them one.

    I am not embarrassed and I do not agree that I was rude. If the moderators think so, they are free to tell me so.

    You come to this board expecting free volunteers, with no information whatsoever, to come up with concrete answers to questions that do not have black and white answers, and when they get frustrated at your refusal to provide any information while still demanding exact responses, you tell them that they are rude.

    Well, guess what, Albert, you don't have to worry about my "lack of empathy" any more. (And why should I have any empathy for a kid who thinks it's funny to assault people?) You're on your own. I'll go help someone who's willing to actually give me some information to work with instead of insisting that I read the minds of not only the poster, but also the unknown police in the unknown jurisdiction and then berates me because I can't pin down precise answers for him.

    Good luck getting answers from other responders.

    thank you. I'm going to relay that information. As far as I can tell this is a nice girl I have met her...she is a little innocent kid who in play hit a girl in the head....it seems no serious injuries exist. If they do well then something isn't adding up and something has happened not being told yet.

    I never asked for concrete answers or display much anger. I understand my questions were un specific and lacking in information but you can explain that in calm terms and still provide helpful information.

    and even if guilt, which obviously the child is not yet.... if you can't emphasize with a criminal I would hope you are not practicing law!

    I suggest you think about the words you have said and put them in context of a face to face conversation....would it be ok to talk to someone like that?

    I have no problems with anything I have said.

    A child older than five who does not understand that it is never all right to hit someone does not need empathy - she needs a serious wake up call. Hopefully this will provide one. Even if I can't tell you out of a clear blue sky exactly how long she will be held at the police station.
