Hitting Somebody as a Joke and Causing an Injury
My question involves an injury that occurred in the state of: IL
A student at a local highschool I know had an incident happen today in which the student hit a peer on the head with a binder. It was apparently in a joking manner. The peer left class and went to the emergency room...this is all that is known about the peer...I would assume there are no serious injuries though. Later the student was called down to the office and a police officer and said to come into the police station the following day and that under no circumstances should the parents or peer be spoken to.
this is all that is known so far. I would assume the student was asked to come in for questioning? but why was the student told not to contact the peer/parents of the peer.....have charges been pressed yet? Does the student or should the student even go in to the police station? Is it reasonable to talk to the the parents of the peer and try to work things out?
do we need a lawyer at this point?
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
Sorry, my crystal ball is out being recalibrated.
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
I understand not a lot of information is presented but surly any expert can help with some answers here specifically
Does the student or should the student even go in to the police station if told to by the officer?
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
Yes. If the student is told to go to the police station by the officer, then he goes to the police station with the officer.
Why is that hard?
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
The student was told to come in to the police station....the following day. Im sorry. This was a highschool cop and the cop said go to the police station the next day.
The other question is the police said dont talk to the other family. Is there any legality to this and is it a bad idea to do so? seems like something that can get worked out easily
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
You are looking at being charged with a crime for hitting the other student. You should be lawyering up, not planning a course of action that could potentially result in additional charges.
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
Can anyone fill me on what the course of action will be at the police station assuming the student is arrested? We can't afford a lawyer barley making it by as is so I don't know exactly what to do.
1. if she is arrested for this crime will she be held at the station ...and for how long?
2. what is the court appointed attorney process?

1.) See crystal ball, above.
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
Really? I would understand that on video game forum or something but this a forum which is about serious matters to people who are in stressful times your attitude is just really hurtful and unnecessary.
Re: Under Agree Student Being Sued for Incident at School Police Said Come into Stati
Why do you keep saying "we"? You're pretending you're not involved, remember?
You're a minor, so you can take a parent with you to the police station. You have the right, as they say, to remain silent.
In terms of an arrest... we're back to that crystal ball thing. But you'll be accompanied by a parent, right?
If you are charged, you can ask the criminal clerk's office of the court in which you're charged how to petition for a court-appointed lawyer.
