    Can I Get Temporary Sole Custody if My Ex- is Divorcing Again
    My question involves a child custody case from the State of: Minnestoa

    My ex and his wife of a few years are now divorcing but no one knows when she will actually be moving out of his house. We have joint 50/50 equal custody and live near each other.... do I put in for a temporary custody order until she moves out of the house? I don't care if their dad sees them, I just don't want them in that house when their step mother is there.
    She has always been manipulative and not so nice to our children and I had to sever my relationship with her quite a while ago due to her overstepping boundaries and impersonating me (as our children's mother), etc.
    I did ask my ex if they could stay with me until she is gone, but I have not heard back from him. Thoughts? She does have two children of her own. It was getting nasty.. our children (and I) found out about the divorce at school, days before my EX could tell them, but I told the children to wait to talk to dad and not listen to anything/anyone else. Then he told me, so it was true. And his wife is bad-mouthing him too. I fear for my children as I already have had issues with her not being so nice.

    Not to put too fine a point on it, but what makes you think a judge would grant it?

    The children have been living with her for however long, the fact that she's leaving at some point does not represent a change in circumstances meriting such a change in custody. Quite the opposite.

    If Dad hasn't responded to you, it's likely because he intends to maintain custody arrangements per the current court order. Be a mensch, don't pile extra court nonsense on him.

    Me too lol :). I have an appt with my attorney in a few days but I wondered if I should just add this in with all the other "stuff" too. I'm just worried about our children due to issues she has put them through in the past. He did respond and thanked me for the offer but said he did not want to disrupt their schedule any further.

    Ps thing are looking up already.. He responded LOL
