Changing a Child's Name After the Death of the Father
My question involves name change laws in the State of: Oklahoma
My sons father passed away 6 years ago. My son would like to have the same last name as his step father and I. How do I go about changing it? Do I need to get an attorney or is it something I can do without an attorney? Thank you in advance!
Re: My Sons Father Died, How Do I Go About Changing His Last Name to My Married Name
It shouldn't be too difficult even without an attorney.
The only person with standing to object is Dad, and that seems to be a moot point.

Ultimately the court will decide if the child having a name not related to him by blood or marriage is in his best interests. You can file yourself.

Lets see, mom is related to him by blood and stepdad is related to him by marriage, so where do you get that?

No idea, but the "best interest" standard is likely moot too. That only becomes an issue if the other parent disagrees...
