Can I Sue the State for Making Me Prove Good Character to Get a Name Change
My question involves name change laws in the State of: North Carolina
Alright so I am an adult in North Carolina who desires to change my name due to personal reasons. I am not trying to change my name for criminal purposes, I just don't respect my birth given name. Unfortunately North Carolina state law dictates that I must first file a petition and have two affidavits of good character however, I must get it notarized. This is the hard part because lets be honest it is a gigantic hassle to take two of my friends and go to bank sit down in front of a notary and have them verify they are who I say they are, by asking them questions and sign my petition for name change. Most of my friends feel uncomfortable being interrogated by a notary. I believe it is unfair that I must rely on two other people to change my name as it is my right to change my name, why should i rely on somebody's signature? What should I do? I intend to file suit against this law.
Re: In a Very Interesting Situatiion Definately Not the Normal
1. Your lawsuit will go nowhere, and cost you a lot of money.
2. Why do you believe this is a "giant hassle"?
3. The notary will do nothing other than confirm you're all who you say you are. No interrogation. You show your ID and that's it.
4. Your situation isn't uncommon or interesting ;)
5. You absolutely have the right to file a petition to change your name. You also have the right to follow the State's guidelines.

I am a former notary.
The "interrogation" you object to will consist of the following: "May I see your ID please?"
Re: In a Very Interesting Situatiion Definately Not the Normal
either your friends have some serious psychological issues or some issues with the law or those you are calling friends aren't really friends.
and have it on the suit. Let us know how that goes for ya.
I do agree that the rules required to change your name are onerous. You can always move to a state where the rules are not so cumbersome.
