When Can You Get Venue Changed for Child Support
My question involves a child custody case from the State of: California.
I have full legal and physical sole custody of my 5 year old. This is a really long story but ill try my best to explain.
The father of my child has always been abusive in 2009 I left him and was awarded full legal and physical custody
I did allow him to see my son when he wanted but he took my son in 2010 and disappeared for a week. When I
got my son back I did not let his dad see him for almost a year in 2011 he did the same thing this time for a month.
I got my son back thru going to emergency exparte hearing and the judge ordered he returned my child to me immediately.
After that he came to my home and attacked me in front of my child countless times. I reported a few major incidences to the police.
He went to jail 6 months. When he got out he did it again I filed for a permanent restraining order against him with no visitation of my
child. The judge granted me a 3 year restraining order with no visitation to my child unless he finished 6 months of anger management classes
which took him 2 years to do. Now hes back and he got a lawyer and won one day every other week supervised visitation but he talked the judge
into allowing his mother to monitor the visits and she is not doing a good job. She doesn't tell me when things go wrong (he yelled at my child and broke
a skateboard in front of him because he fell off it). And a few other small incidents. I hired a lawyer and tried to take away the visitations but the judge wouldn't
budge. Our case is in California but I moved to Nevada about 7-8 months ago So every visit I have to take my son to visit his dad for I have to pay the gas for over a 4 hour drive not to mention buy a hotel for a night. Which is getting very expensive. Child support agency is attempting to collect $75 a month from the father of my child.
Which so far its been 6 months he has supposed to been paying and he has not paid. He was also supposed to provide half of my sons health and dental insurance. Which he had not done yet. Also the judge ordered both of us to take parenting classes which I completed its now been 3 months and he still had not done his classes. He did give me $20 on this last visit because I did not have any money left. I am a single mother struggling to raise my child and now I have an additional 300$ a month just so his father can see my son. When he is not willing to help out at all. I want to transfer my case to Nevada but im not sure how to go about this. Do I go to California and request and change of venue? Would they even grant it considering this judge in California is so keen to let my sons father be back involved in my sons life?

My sons father is teaching my son curse words and to disrespect me which he has never done. His mother who is the supervisor- does not like me since I left her son 5 years ago and not to mention she stands behind her sons back even after all hes done to physically hurt me and my child. I am backed into a corner and sinking fast. please any help is much appreciated I need some advice. :wallbang:

Re: Custody Battle Gone Wrong. Need
As long as Dad remains in CA, so will the case as a general rule.

Essentially though, it's going to take something major in order for the court to completely take away Dad's visitation. If you'd rather someone else supervise visitation, you may find yourself on the hook for the costs involved.
