Father Wants to Change Baby's Last Name
My question involves name change laws in the State of: New York. I was never married to the father of my baby. I left him because he didn't take responsibilities and he didn't even care if I was starving or not so I left and got helped from my parents. I had the baby and I put my last name on the baby's birth certificate, the father left and didn't know anything of him until 6 months that he showed up without even helping or even bringing anything to the baby. The second thing is that he took me to court for paternity and it's established, but I have sole custody of the child and I've been doing everything on my own because he doesn't help out so took him to court for child support even that he can't even pay child support. The baby's doesn't like him cries when he sees him even hides when he sees him. I wanted to know can he change the baby's last name if on the birth certificate has my last name can he do that???

According to the Suffolk County courts, unless you agree to the change, the father can only ask for a name change after paternity is established. That would be a separate legal action.

Babies and infants often fuss when they're with anyone other than the mother at first.
This is normal.
That's not going to help you one way or the other.

He can ASK the court to change the baby's last name. However, that is not a guarantee that the court will automatically do so.

i'm sure that if the father was posting a different story would be presented; baby crying does not enter into the equation; highly unlikely that a court would order a name change at this point in time but a judge could order it.

Well i LIve in Nassau county and I went to my lawyer and got my information and even if he has the greatest lawyer he is not getting that last name change because first off me and him were never married. So thank you

Uh..reality check.
You're not going to be the one making that decision. Marriage has NOTHING to do with anything.

Except that when a man isn't willing to marry you, that should tell you a LOT about what you might look forward to in terms of how committed they are to supporting and raising children with you. If he's established as the legal father, he's got an above average chance of having his last name added to the child's last name, resulting in a hyphenated last name.
