Ncp Receiving Assistance - Problems for All Involved
My question involves child support in the State of: Ohio
BACKGROUND:
We are in Ohio
My husband two children with an ex-girlfriend.
These children were born in Indiana, and the agreement was filed there.
Custody, in the (very short) agreement gives joint legal, and him physical. The agreement states the mother gets every other weekend and one night per week. The one night a week is Thursday, and they have been staying there Friday night on her weekend as well, for an extended weekend. IT amounts to about 10 overnights per month.
The agreement states that the mother pays child support. Since the agreement is old and from out of state, there is no wage withholding from her. She does give him a small personal check (about) every 2 weeks.
The agreement states that the mother is to provide medical coverage. She has done so. Prior to about a year ago, they were on her husband’s employer-provided policy. At that time, he lost his job, and they were put on her policy. From January 1, 2012 through October 31, 2012, they had my coverage as a secondary. From October 1, 2012 through now, they have had my husband’s.
ISSUE:
On Friday we found out that the mother has enrolled the boys in Medicaid. She has been taking them for medical services (unknown to my husband,) and not claiming his coverage. Yesterday (Monday) was a holiday, so nothing could be done, but he does intend to call Medicaid and let them know he had coverage that should have been billed.
-Is it possible that my husband will be in any trouble for fraudulent Medicaid use?
-Is it possible that my husband might have to pay the state since his children are receiving assistance?
-He has no knowledge of what the mother gave as his status in the children’s lives. Is there a potential problem, custody-wise?

I'm not seeing any fraud at all. Yes, if Mom has legitimately used Medicaid (and she is allowed to sign up even if there is prior coverage, if that coverage isn't complete) the State can come after Dad for reimbursement.
If Mom gets in any trouble though, your husband shouldn't be involved in it - he is obviously unaware, and obviously not a participant even if there is an issue of fraud. He has clean hands.
I do advise him to actually call them, as you suggested. This might be a simple fix :)

I understand about her being allowed to apply even if there is other coverage. But doesn't she have to let them know there "is" the other coverage? She didn't. His coverage would have paid, but Medicaid didn't know about it, and they did. If it's not any kind of fraud, GREAT!!
So the state can come after my husband for money since she did use it?

He is calling for sure... We just don't know what questions to be sure to get an answer to :(

He needs to give them basic information - he's the CP, all of that. They generally won't give him too much information relating to the actual application, but there's no harm in him explaining all of it.
It would be nice if she let him know she'd signed up but alas, she has no legal obligation unless the court order requires her to do so.

I figured they won't tell him about her case. But I would think they would tell him if he is going to be on the hook for bucks over it. Those are the things we need to know about to ask. We just need to know if it will cause him problems, and if it will cost him money.
