When Should Child Support End
My question involves child support in the State of: New York
My daughter's mom filed for child support in Las Angeles, CA. I live in New York. My daughter is turning 18 yo next month, and in CA the age limit for child support is 18, but in New York is 21. I was told I have to pay until she's 21 because of that. How real is this? Can I say something to the judge in my next appearance in court about this age limit?
On the other hand, the mom says is not working, but she is. She is illegally here and she makes money off-the-books and because she "kept" my daughter, my daughter lost her legal status (I'm under a working visa) and I lost total contact with her. Besides, she has a partner. Does this help in some way?
Re: I Live in New York and My Daughter in Los Angeles, California
If the order is out of New York, you pay according to New York's rules (which does indeed end at age 21).
The rest of your post doesn't affect anything at all. Her illegal status didn't bother you when you were together; the court won't care at this point. She could marry Bill Gates and it wouldn't change your child support obligation - New York takes a straight percentage of the NCP's income.

Do you have any current orders from New York?
Re: When Should Child Support End
You need to share the relevant background information. For example, is this a relationship that existed in New York, with mom only recently moving to California with the child? Is this a California relationship where you moved to New York? As FatherWhoWon asks, are there any existing custody or support orders and, if so, from what state?
Re: When Should Child Support End
Well, I'll try to be more clear. I was trying to be "brief".
She got pregnant in Mexico. We never lived together, but I always took care of my daughter. I spend time with her, and her mom and I were fine. I moved to USA in 2005. First as a student, then I got a job and got my H1 visa. The mom move to CA. She came with her boyfriend at that time, and both of them came illegally. Again, we were never married or live together. Because of that, my daughter was left behind with her mom's family. I got a visa for my daughter, so she could come to live with me. I consider that it was important for a child to be in touch with both parents, so, I send 3 years in a row my daughter to spend the summer with her mom, so, they coud see each other and spend quality time. Even though, my daughter travel to Mexico to visit her family there, and come back. I never restricted that kind of communication or visits.
However, in 2010, the third year my daughter went for summer vacation, she didn't come back. Suddenly she was against me, and it was clear her mom has turned her over me. She said she was going to stay there and well, many other things that I don't think worth to say here. They stopped calling, never pickup the phone, no emails, no response. Since she was 14 at that time, I thought it was not fair to put a child through this kind of things, go to court and maybe have her mom in immigration troubles, so, I didn't do anything about it. However, I kept trying to get in touch many times, but no replies. I emailed my daughter about her visa and passport about to expire. She replied. We got her passport renewed, because the lawyers at my company needed that information to file for a visa renewal. After the passport renewal. Stop emailing, again. No response. Nothing.
She just called two weeks ago, asking for her visa renewal. I told her I have to submit that question to the lawyers and I was going to call her next week. I did, I called her and the phone is not in service any more. No responses by email. Nothing, again.
