    If You Nail Barbed Wire to Trees, is it a Fence
    My question involves real estate located in the State of: OHIO

    Can barbed wire be nailed or stapled to trees to form a fence in the state of Ohio. There is a tree line
    that runs down my property line ,some trees are on my side ,some on other side of property line,and
    some are in middle of properly line.Neighbor nailed barbed wire to some trees on my property and to some
    trees that were half on my property.What are the rules about trees close to or on property lines in State
    of Ohio

    Apparently, the use of barbed wire is legal in Ohio as long as it's at least 48 inches above ground.

    See ORS 971.01 (F).

    However, the trees on your side of the property are YOUR trees and he's basically vandalized them.

    If you want to make a federal case of it and escalate hostilities, call the police and report the vandalism.

    The alternative is to just cut the wire where it attaches to your trees and remove an wire embedded in the tree and tell him you'll call the police and get him charged with vandalism the next time he does it.

    As for trees on his side of the property line or his halves of any tree on the property line, he's free to do what he wants on his side.

    Presumably there's more to the story here, or these neighbors would already be talking to each other like adults, but the police have better things to do than to try to figure out who owns what tree along a property line - so I would start with the "let's talk to each other like adults" thing.

    I did go to neighbor and his reply was, You always find something to B---- about. I then told him it
    was a simple fix and he walked away.
