    Business Interruption Due to Repair of Ceiling
    My question involves landlord-tenant law in the State of: California

    Hi,

    We have been renting this property as our retail store for about an year now. Recently, we had problems with the ceiling which our land owner has decided to fix; the ceiling started to crumble and the lighting fell to the ground. Unfortunately, he said the re-construction will take 3 days and the store would have to close business for the time being.

    and here is our problem,

    October, November, and December are the busiest season for our store. Daily revenue during these three months are on average about $10,000, which is about a double compared to the rest of the year. For this reason, we have asked our land owner if he can have the contractor come in and work on the ceiling after business hours; which he responded by telling us that in this case, we need to pay for the extra fees for overtime.

    In cases like this, do we have no choice but the close the store for 3 days which will lose us $30,000+? Do we have right to at least postpone the construction until February or does that oppose with the safety regulation? The problem with the ceiling was not caused by us. We have a letter from the previous tenant that states that the ceiling problem was an issue for them too.

    Sooo what did the landlord say when asked to delay the construction until January?
