Possessino of an Empty Molotov Cocktail
My question involves criminal law for the state of: HAWAII
i recently got pulled over for speeding a few days ago. the officer looked over in my passenger side and found 4 empty molotov cocktails which i put together for an art project for school. make a long story short the officer gave me a ticket took away the molotov coctails took down my info and notified me that he will be forwarding this to the prosecuting attorney here in Hawaii as he was unsure if it was illegal or legal to have empty molotov cocktails. im a bit worried and wondering if i will be getting in trouble for this.
Re: Caught with Empty Molotov Cocktail Illegal or Legal
An empty Molotov Cocktail is an empty bottle with a rag sticking out of it.
I don't think that qualifies as a "deadly or dangerous" weapon per 134-51:

But there may be other statutes involved that I haven't found.
I suggest that you go see a lawyer who specializes in weapons law. Might cost you a couple of hundred for a consult but it would be worth it to find out if you are at risk so you can prepare for it.
Or, you can just wait and see what happens. It's possible that the officer just tossed them and didn't file a report. That's a lot of paperwork for a few empty bottles.
