Destruction of a Security Camera
My question involves personal property located in the State of: California
I have an unruly neighbor who I caught on my security tape bashing my security camera with a 2X4. The camera never did stay in place right afterwards (meaning it was damaged) so now I want to sue him in small claims... but about a month later he had his daughter's thug boyfriend rip the camera down and steal it. Can I still sue in small claims for property damage to the camera regardless of me no longer having the camera because it was stolen?
The security camera clearly shows my neighbor wacking my camera until it spun around 180 degrees.

Do you have proof of the damage to the now-missing camera? Hitting it and moving it out of place doesn't mean it was damaged. But, if you have pictures of the damage or estimates for repairs, AND the video of him actually whacking it, you may well have a case against the guy who smashed it.
