Does an Adjournment in Contemplation of Dismissal Result in a Criminal Record
My question involves criminal records for the state of: New York
Hi, I am a first time shoplifting offender in the state of NY. I was given an ACOD, adjournment in contemplation of dismissal, at my first appearance in court.
My questions:
1. Do I have a criminal record? If I wasn't convicted, my thoughts are no but I want to be sure
2. Will the arrest be seen in an employee background check?

For most purposes an ACOD (when successfully completed) is like it never happened.
However some searches such as for law enforcement agencies, immigration activity, security clearances ask about and can discover such dismissed charges.
