Arrested on Only One of Two Outstanding Bench Warrants
My question involves criminal law for the state of: Tennessee
So, me & my boyfriend got pulled over & they ran his name & found out he had an arrest warrant in Memphis, TN for Aggravated Burglary & took him in. But he also has a bench warrant in Collierville, TN for Contempt of Court - General Law on his record online. The warrants were both put out within the same week & they're both in the same state, so why didn't the police ever mention the bench warrant? He's currently in jail awaiting court & trial for the Aggravated Burglary charge, but I am bonding him out tomorrow. I'm wondering if when they get ready to release him & check his name & record again, will they mention the bench warrant then? If they do, what will happen to him? & Why wouldn't they have mentioned it to him earlier, like when he got arrested?

I am not familiar with the geography of TN…but, I am presuming that Memphis and Collierville courts do not book into the same jail. With government’s all over the country having budget crisis, they are frequently unwilling to pay for the cost to house and transport people with warrants for low priority crimes. If a person has a warrant in county A, but gets arrested in county B, county A would have to pay county B to house the person in jail and pay to transport them back to county A. So, for low priority crimes, they will specify on the warrant that they will only extradite from specific areas.
Aggravated burglary is a fairly high priority crime that would likely be extraditable state-wide and maybe even from out of state. Contempt of court is lower priority and the court that issued the warrant was possibly unwilling to pay for extradition. If the warrant specified this, there would be no reason for the cop or jail staff to even bring it up.
However, Collierville now likely knows that your BF is in jail. They still could request a hold and go pick him up…I don’t think that likely, but it is possible.

Oh, and Collierville & Memphis are in the same county. They have seperate jails I think though. So what does that mean? He got arrested in the same county as both of the warrants but is only being prosecuted for the aggravated burglary. Noone has even mentions the contempt of court to him, so will they still hold him?
