That's why I suggest customer call the store, advise them of what happened. Name the cashier and lane, and time. And not name his/her name. That way....the store is aware and can check cashiers receipts and even video, if cashier is still working can have LP having extra watch on the cashier. And the Original Poster doesn't get into any trouble.
As someone who worked LP for many years, I can say that I have seen people come back in and pay for unscanned merchandise. It was very, very rare. If it was a slow day, I might review the video on the transaction for 1 or 2 items. If it was multiple items off the same transaction, I definitely reviewed it. Generally, it was considered someone being honest unless their demeanor indicated something else.
If someone took the merchandise knowing that the cashier had not scanned it, that is wrong. Whether it is legally or morally wrong would depend on the jurisdiction. But if you know the person didn't scan it, you know you have no right to it. Even if the employee is mad at their boss, it doesn't give them the right to give away free merchandise.
