Does a divorce petition expire?
i live in texas and filed for no contest (no children) divorce on 31jul06. my husband signed the waiver of citation (which i still have here in my files but not submitted to the courts) and i drafted the decree, although that is where it ended since he is trying to prove that he is a changed/better man. is there a time limit on what i submitted at the end of july, just in case things don't work out between me and this "new" man that he claims to be?
Re: Does a divorce petition expire?
If a court summons is not served by a date which is often indicated on the summons itself, it expires. Even after service, if no progress is made on a case it can be subject to dismissal. You may be able to get the court to adjourn the case for a period of months while you attempt reconciliation. The court clerk may be able to advise you of the status of the case, and when dismissal might occur if you do nothing.
