How to Fill Out Name Change Forms
My question involves name change laws in the State of: California
I am trying to fill out form CM010 for a name change that is not caused by divorce, etc but I just want it changed to the maiden name. Here are some questions regarding certain sections.
Sec 1) I selected "Miscellaneous Civil Petition - Other petition". Is there any area where I need to indicate "Petition for Name Change"?
Sec 2) From all I see this "is not complex under rule 3.400"
Sec 3) I am not seeking any remedies so I assume I just leave section 3 empty
Sec 4) I am not sure what "causes of action" is. Do I need to enter anything here?
Sec 6) My wife is also going to change her name which we will submit together (two separate sets of all form). I assume I don't need to fill out CM-015 because I would not know her case number since we do it at the same time.

Flip over your CM-10, to where the instructions are located. Now look toward the bottom of the page below the heading "Case types and Examples", under "Miscellaneous Civil Petition; Other Petition". You will find "Petition for Name Change" listed as an example. As you can see from Rule 3.400, your case is not a complex case under that rule. You are seeking nonmonetary, declaratory or injunctive relief. You are petitioning only for a name change, so that's one cause of action. The Form CM-015 would not normally be something to file, but if you want to try to get both petitions before the same judge you may want to ask the clerk if you should each file the form identifying the other spouse's case.

I have a son that is 10yrs old. I was married but separated when I had my son. I receive family first my son last name is in my ex-husband name. I want to change my son's last name to his father name. The father has changed his name because he don't want to pay child support. H only takes care of my son when he wants to. What do I do?
