Adult Claiming Back Child Support in Texas
If my mother owes my father child support can I receive it? Under the circumstances I believe I deserve and need this money more than my father. I have not resided with him since I was 14, yet he continued to receive occasional payments from my mother. Is there anyway I could get the money sent to me instead of my father?

It's not owed to you. It's owed to your father.

Perhaps thanking your father for supporting you while your mother didn't, would be nice.

    No.

    It really is that simple.

My point is that he didn't support me he threw me out at 14 and I had to support myself. He spent all the money mothe mother sent him while I was young on beer and not me. My uncle and my friends parents got me the things I needed and food. They were even the ones who gave me a roof from time to time. I worked hard to get where I am. He doesn't deserve a thank you.

    let's dissect that question:

if your MOTHER owes your FATHER, do I have a right to intercept a debt owed to my father because I want it.

    that would be a no.

Mom should have sorted it out in court.

And if you were tossed out at 14, you should have and could have made alternate arrangements to ensure your health and safety.

so what were you doing on beer?

Your mother had the ability to seek a termination of the support. She didn't, she continued to owe.

but that begs the question; why did no you return to your mothers home?

Actually, I'm going to suggest something.

I've been dealing with family law for far too long now, but my memory is bugging me. There is at least one state which, in certain circumstances, DOES allow an adult child to file to receive child support owed to the parent. The conditions are generally "death of the receiving parent", but if you really want to satisfy your curiosity go and see a local family law attorney.

I forgot the comma. I was not on beer, he spent all of the money on beer.

She had no idea I wasn't staying with him.

I wasn't legally allowed to live with her.

well, actually, this is where you are wrong. It really is that simple. Your mother owes your father and you have no claim to it.

I know what you really meant but I do have fun occasionally.

Then that is her fault for never checking on you.

You weren't legally allowed to leave your father's home either but you did that.

If you look at this in a different way, your mother should not actually owe your father. That means, if you want to argue semantics, you have no right to take money your mother pays since she should not even be paying it. It should simply be forgiven and all will be well with the world.
