How Does a Roommate Prove Ownership of Property When Moving Out
My question involves landlord-tenant law in the State of: louisiana
My sister rents a 3 bed house. Long story short. My daughter and I have been staying there. It is now time to move out. I gave her a verbal 30days notice. I am not under any lease or contract. I am paid up on all my bills. I have decided to move out early with out her knowledge. I fear that she is going to try and keep me from taking certain things that belong to me. Ex: washer dryer bed few pots an pans. So my plane is to move while she is gone. My question is if she shows up... does she have the right to say what I can and cannot take? If the police are called for a civil assist will they let me get the rest of what's mine? And what if she hits me? My sister is a drugy and can be be very irrational and violent. I want to be able tonprotect myself but do not want to risk any charges on myself. Any help would be greatly appreciated!
Re: Do I Have Rights to My Belongings when Moving from Roommate
How would the police know who the washer and dryer belong to?

" If the police are called for a civil assist will they let me get the rest of what's mine? "
We cannot second guess how the police will respond but they may very likely refuse to assist you without a court order granting them the right to do so. These domestic type situations can often become violent and quite honestly, the police realize that it is difficult to determine who is telling the truth in these sort of issues.
They are also likely to tell you they don't have time to stand around waiting for someone to haul washers and dryers out of a home.

What about my safety? If she hits me? Am I allowed to defend myself?

So, you're asking us if it's legally OK for you two to beat each other up?

Um no. I asking if she hits me do I have the right to defend myself. If she hits me and I push her away so I can get away will we both get charged for a crime? She has attacked me before punchin me in the face and I had to wresle her to the ground till she calmed down. When I told her I was calling the cops she said that if I do we would both get charged. I am not looking to fight her. I just want to know what I can do legally to protect myself from her drug indused abusive bullying behavior. I have never been charged with a crime and don't want to be. She already has a felony and currently going to court for battery.
