    My question involves criminal law for the state of: Connecticut

    I shoplifted a necklace at Kohls worth about $12 and was caught over a month ago. I was stopped on my way out of the store (I bought other items) and brought to the back by two LP officers. No police were called and the item was returned to the LP undamaged. I gave them my personal information (SSN included) and a picture was taken. A trespassing document was signed along with another piece of paper that I do not remember. It was all a blur and I can barely remember it exactly. I have not received a Civil Demand letter yet, but I assume I will get one. When this happens, I plan on paying it immediately. I am not expecting it to exceed $300, or at least I hope not. I am an adult.

    My questions are:
    -How long does the ban last for Kohl's? And if it is a lifetime ban, can I write to the corporate offices and have it appealed eventually?
    -What are the chances that I will receive a court date? No police were called to my knowledge since I cooperated at every step. The merchandise was returned undamaged. I know you cannot tell me for sure, but only guess. I have heard of people receiving a court date months after the incident when no police were involved as well and I am terrified that I will eventually get one too.
    -Will this affect any scholarship I have as a college student?
    -Even if I am not convicted of any charge, will this impact my chance of receiving a job in retail? Or impact the current job I have (which is also in retail)?

    This was the first time I have stolen anything and thus it is also my first offense.

    1. The ban is for life. However...wait 6-12 months, write an apology and ask for permission to shop again. You will send this to the Corporate Office (you'll find the address on their website), addressed to Loss Prevention. Wait until you get a letter granting permission.

    2. Pay the Civil Demand. Hopefully that will be the end of it. Kohl's can send the report to the police, so we can't guarantee that won't happen.

    3. If a police report is filed, it is possible.

    4. Without a police conviction, it should not affect retail jobs. Just I would not apply at Kohl's. And if that Kohl's is in a strip mall, I would not apply at neighboring stores.

    Thank you for your quick response. If Kohl's did report it to the police, do you have any idea how long it takes for a court date to be mailed to me? I assumed it would have been closer to the incident, but since they are slow with the Civil Demand, should I expect it to be a few months of waiting?

    Also, you say it should not affect retail jobs without a police conviction. What about the National Theft Databases though? I'm not entire clear on how those work.

    If they do report it to the police, it could be anywhere within a day to 1-2 years, whatever the statute of limitations is in your state. $12....I would not worry.

    National Retail Theft Database requires a court conviction.

    You will be in Kohl's Database. If that Kohl's is in a mall/strip mall, possibly the malls database, too.
