My question involves criminal law for the state of: Texas
This is my first time on this site. I have a few question but first this is why I am being charged for Burglary of habitation. I don't have a police record and I am 19 years old, with two dislocated disk on lower back L4 and L5.
In July I was asked questions about a burglary that happened in Arlington, the guy who was asking me question said I was the main suspected he told me he had video of me and my car at the house and that he had witness which were the neighbor Ben who is my ex boyfriends best friend and who dated his sister, he then questioned my current boyfriend at work saying he was the main suspected and they had video of him entering the house after my boyfriend and I asked so see the video the guy said I will see it in court and told my boyfriend if he went to the station with him he could see it there, he said no he wasn't going because he didn't do anything. My ex boyfriend and I have been broken up since April after having an accident at walmart when I had a really bad back spasm, I was hospitalized then discharged the same night, four days later my back was still acting up I couldn't walk, my ex wasn't really helping me around the house I went without eating or drinking anything for those days. I ended our relationship on the forth day he was very upset and throwing a tantrum, the same day I left his house I was hospitalized again for the spasms, I was hospitalized for a week, while in the hospital he kept going to my parents house leaving notes and items I left behind, my mother also notice his car pass by a couple of times we were going to get a restraining order but we didn't do cause we thought he will stop eventually, I was discharged with restrictions which are no driving, minimal walking and standing, I was but on bed rest until I saw my doctor. The month they said his house was burglarized I was going through epidural shots, I wasn't aloud to drive until my surgery that was going to be done in Aug. After I got my surgery in last month I was told I could drive again after two weeks but I couldn't drive a certain amount of time. Three weeks ago I was going on a trip with my family to celebrate my back getting better. I was sitting on the plane when I was removed by three officers saying I had a warrant for my arrest I had no clue what was going on so I went, the officer tried being a smart aleck and saying if your so hurt why are you flying he didn't notice I had a note from the doctor saying I had to get up and move around when I need to plus the back and neck support the doctor gave me for the trip. The officer arrested me and but my hand behind my back which was hurting the back because of the surgery he then notice my scare when he tried putting me in the car and my shirt lifted up from the back he then but my hands in the front of me, I now have to go back to the doctors because having me bend forward and sitting in the jail without my meds and brace I am having back problems again. I have a lawyer and he wants me to pay him $1200 for a retainer fee. My first question is what can I do because that is a lot of money and I know I'm not guilty? What possible evidence do they have to arrest me? What can we do about the officer being so rough with me and now having to pay more doctor bills because what he did? Can I press charges for false allegations on my ex boyfriend? Why did it take so long for them to arrest me for something I didn't do? Please help really stressed out, thank you.
We don't know what evidence there is against you. If you feel the officer was out of line file a complaint with his commander. No you cannot press charges for false allegation - there is no proof of that. They arrested you when they did because they felt they had a strong enough case.
Sorry to hear about the stress, but hey it is a part of life.
Oh yea, I do suggest you speak to no one but your attorney.
