Misdemeanor C Assault Charge in Texas
My question involves criminal law for the state of: Texas
I've been given a citation(ticket) for a Misdemeanor C, Assault by contact. It's been dragging along for sime time and I want to get this over and move on. Court date is early October. My questions are:
1. Can I request from my attorney to seek a plea bargain for a non-assault charge within the Misdemeanor C category? Ex. Littering. Traffic violation, etc.
2. What's the burden of proof for Misdemeanor C Assault by Contact in Texas?

If you want to get it over, plead guilty. You can request your attorney do anything. Whether the prosecutor plays ball or not depends on the outcome. That is usually related to the evidence.

I don't mind pleading guilty, I would just like to plead guilty to a non assault charge? Is that out if the ordinary? To request a littering charge instead, for example..
