    Working Two Full Time Jobs at the Same Time
    My question involves employment and labor law for the state of: California

    I am working full time (W2 employee) as Sr Software Engineer for a Reputed Bank. And I work-from-home all the time. Work load is very minimal.
    Now, I have an offer from another consulting company as Software Engineer (Full time job, as W2 employee) where I am required to work-from-home as well. I am sure I can easily manage working for these two employers at the same time.

    My work status is Green Card. Work load wise: I am sure I can easily manage the above two jobs.

    I just want to know is this legal to work for 2 employers at the same time?
    And is there a way my 2 employers can find out about another jobs while running payroll or while generating W2 forms, etc?

    Please share your thoughts - any inputs would really help me decide.....

    No. it is not legal to commit time fraud by claiming you worked the same hours for 2 employers. In fact, one of them might terminate you for having a second job. If you are currently committing time fraud that is illegal also.

    I read the question differently than Disagreeable.

    There is nothing whatsoever illegal about working for two different employers. There is not even anything illegal about working full time for two different employers. Plenty of people work second and even third jobs. There's no problem with that. I've done it myself, and my husband is doing it still.

    The ONLY thing that would be illegal would be if you told one of the employers that you had worked hours, for that employer, that you had not. And that would be illegal regardless of whether you worked two jobs or not.

    It's legal.

    I saw nothing in your post that raised a suspicion that you would bill anybody for hours you didn't work so I don't know where the other responses came from.

    But, to be on the safe side, make sure your agreements include billing by the job and not by the hour.

    They can find out any number of ways that no one can predict.

    Any one or more of your employers (or clients) might not like it and terminate you for it. And that would be legal, too.

    I should have clarified that a bit more. You can work for more than one employer as long as you are doing so in a legal manner.

    I didn't see any such suggestion either - I mentioned it only to clear up any confusion about what is and is not allowed.

    I like the idea of billing by the job and not the hour.

    thanks a lot adjusterjack, I appreciate your response.

    yes, both these employers are billing by the job, and not by hour.
    in one of the jobs, I will be working with offshore 100% of the time - so that work is mostly in the evenings as per US timings.

    the role is Work-from-home, and to complete 40 hours a week - I can also work over the weekends to catch up.

    Would you have any idea, in what ways my employer can find out? Because I am sure I will be efficient enough to be on top of everything at both my jobs :)
    I just want to know, by running normal payroll and by generating W2 forms, can they find out? :)

    They sometimes find out when they ask you. If you are suddenly not available as needed for either job,'they might start to wonder why and ask about it.

    Unless there is some association between the two companies, they may very well never know of the other. But, some people talk a bit too much around the water cooler and before you know it, somebody has told the boss.

    No, they will not find out by running normal payroll and/or by generating W-2 forms.

    However, any given industry is a small world and employers know and talk to each other.
