    Can You Terminate a Father's Rights Based on Sexual Assault Charges
    My question involves child abuse or neglect in the State of: michigan

    My daughters dad is going to be going to jail for attempting to sexually assault me and sexually assaulting his other other child's mother. He only in the past 8 months has been consistently in my 7 year old life. My question is with these charges is it enough for his rights to be terminated? My fiancé has been her father figure for the past 4 years and wants to adopt her. Any insight will help, thank you!

    Replacing daddy is not going to be that easy. Even inmates have the right to be a dad. Once you have been married for a couple of years, I suggest you hire an attorney. That is after you get dad's approval.

    Get married, stay married for awhile, and then try for a stepparent adoption.

    No, you don't have enough to get the State to terminate his rights.

    Well, she doesn't have enough at this point anyway...if dad keeps on his current path it may even become a moot point.

    My daughters dad is going to be going to jail for attempting to sexually assault me and sexually assaulting his other other child's mother. He only in the past 8 months has been consistently in my 7 year old life. My question is with these charges is it enough for his rights to be terminated?     If your fiance adopts your child, she will no longer be your child. Nothing you have presented specifically indicates you are even close to a situation where someone you have not married would be permitted to adopt. Come back after you have been married 4 or 5 years and check then.

    I'm thinking OP may have hit the "reload" button, perhaps on her phone if that's how she posted, by mistake and that's why her post appeared twice. They seem identical to me.

    I'm confused why someone else told her that if her fiance eventually adopts the child, that she will no longer be her child. No longer her biological father's child, and not just her child, but . . .

    Because if her fiance adopts the child, it's not a stepparent adoption but a single parent adoption. If they marry and go through a stepparent adoption, that's different.

    I assumed she meant that they were going to try that (right) AFTER they married. Bad assumption I 'spose.

    Generally, they are meant to point out one persons obvious attempt to disenfranchise the rights of the other person. Sorry if it threw you FWO.:tranquillity:
