    What Does the Degree of a Shoplifting Offense Mean
    My question involves criminal law for the state of: michigan
    I was arrested the other day on a retail fraud 2nd degree warrant, my warrant in the mail said it was for the 3 rd degree. How can this happen I have 2 convictions that were for retail fraud but was in 2008. This time it was my mistake because of finals for michigan state I stole 2 5 hour energy drinks to stay awake to study. I didn't get arrested because I ran but I drop the 5 hours on the ground they were not open it was for 10 dollars total price. I just bonded out on 500 dollars because it was a retail fraud 2 be degree. What is going on? Even for prior convictions its very minimal and I didn't even leave the store with the merchandise? Please help, I have 10 days to go to court.

    And since you have prior convictions that means you are a habitual thief. That means they're going to start coming down harder on you. Get an attorney.

    Really? I asked why am I getting charged a higher misdemeanor when It was less than 200 dollars? I know I stole, I know I'm in trouble, just why the hell did it go from 3rd degree from my warrant to 2nd degree when I was in jail??? Don't answer to what I obviously already know.

    Why don't you ask the folks who charged you since you don't like the answers here? After all, we're not the ones who charged you.

    How would we know why? It could be anything from a clerical error to what I've already suggested - a tougher charge because you clearly didn't learn from your first two convictions.

    You're stupid enough to steal over and over; we are not going to assume that you are smart enough to know anything because logically speaking only an insane idiot would continue damaging behaviour over and over again.
