    My question involves a traffic accident in the State of: California



    I was going down a street and obeying the speed limit. Out of nowhere, some lady cuts across two lanes from a side parking lot. The car next to me stopped and I guess let her cut across. I was in the far left lane of a 3 lane road. She cuts across the left lane, then goes right across the middle lane, and comes RIGHT into my lane. I saw her coming and slammed the breaks. My car arrived at a dead stop. She then continues moving and hits my stopped car. Her front hit the side of my car. She cut through 3 lanes and actually went the wrong DIRECTION. Instead of making a straight clean cut across three lanes which is illegal, she actually went the wrong direction too. I came up to her car and asked why she did that. She started getting confrontational and said it was my fault. She wouldn't give me her insurance papers at first. She wanted to see my papers, but it was her fault so I just wanted to see her papers and not give her mine. I called the cops but they wouldn't report to the scene. Her car had zero damage except for her license plate/frame fell off and went into my fender. My car has a torn bumper, fender, and broken headlight. We finally exchanged info and she still blamed me when contacting her insurance. She said I was speeding....She has no proof of that ( I was actually going the speedlimit) She later admits that she never saw my car. Will I win this case??? Here is a picture

    Contact your insurance company and let them know what has happened. They should be able to deal with this on your behalf.

    Hopefully you will not need this but one never knows... And for future reference, it is extremely rare to have someone admit fault at the scene no matter how obvious or complicated it may be. So why argue about it. Also, even if you can decide and agree as to who was at fault, exchanging insurance information is not an option. It is mandated by law that any driver involved in an accident do the following:

    CVC 16025.

    (a) Every driver involved in the accident shall, unless rendered incapable, exchange with any other driver or property owner involved in the accident and present at the scene, all of the following information:

    (1) Driver’s name and current residence address, driver’s license number, vehicle identification number, and current residence address of registered owner.

    (2) Evidence of financial responsibility, as specified in Section 16020. If the financial responsibility of a person is a form of insurance, then that person shall supply the name and address of the insurance company and the number of the insurance policy.

    (b) Any person failing to comply with all of the requirements of this section is guilty of an infraction punishable by a fine not to exceed two hundred fifty dollars ($250).

    If both of you were able to argue and disagree about who's fault it was, then neither of you were rendered incapable as a result of the accident and both of you are required to"exchange" information.
