    Domestic Battery 3rd and Terroristic Threatening Second
    My question involves criminal law for the state of: Arkansas

    1) What are the penalties for these two charges? I know they are both misdemeanors. I believe the battery is a first time charge. Will the person possibly face jail time?

    2) The person charged with this had been charged with terroristic threatening before but I believe it was dropped, would this come into play at court? He had been court ordered to take anger management classes, will this information come up? Or should I make it known?

    3) Lastly, I was reading on assault in Arkansas. and if individual Prevents a person from breathing by blocking their airways; or Prevents the blood flow of a person by applying pressure to their neck they should also be charged with this also, correct? Is it possible to have the prosecutor try and charge the individual with this also? Or will he already face assault charges when court comes since there is evidence of strangulation?

    4) What does the victim's advocate do? Should I contact this person?

    This will be my first time ever going to court so I have no idea about the going on's. Thank you for your help!

    You can look up the code provisions here to determine the potential penalty.

    Your beliefs won't come into play at all. If a charge has been dropped the case will proceed on the remaining charge(s). If not, then the case will proceed as charged.

    There are often additional charges that a prosecutor could file, depending on the facts. Prosecutors don't necessarily file all possible charges. If the victim has questions, the victim can talk to the prosecutor.

    A victim's advocate advocates for a victim. If you are the victim and you want the victim's advocate to advocate for you then, yes, you would contact the victim's advocate.
