Father Not on Birth Certificate and Paternity Never Established
My question involves a child custody case from the State of: Texas
My sister found out she was pregnant after her boyfriend went to jail, she was 18 and made some not so good choices...Anyway she ended up marrying him while he was in jail. He was in jail when the baby was born. They ended up getting a divorce as she realized she needed to better her life as a best she could. He is now out of jail and her daughter is 4 years old and met him for the first time ever. The father has never had DNA established and has never been added to the birth certificate but my sister wanted to do the right thing and let him in her life and meet her while they figure out paternity and visitation and child support but her trying to do things right has now turned into him taking her little girl and now refusing to give her back. The police in the town he lives in told my sister that they cannot make him return her because they said he has as much right as she does.
Although they were married at the time of birth he was never established as the father so can he actually refuse to give her back? What can my sister do at this point? She does not have money to hire an attorney.

The police are right, he has equal rights to his daughter. Your sister needs to educate herself on the rules of civil procedure and FAST.
She will need to file for custody, visitation and support.
