Can Mother Contest Custody After Terminating Her Rights
My question involves a child custody case from the State of: Ohio
A friend's sister suffers from drug addiction and has offered us permanent guardianship of her three year old daughter. She has already lost her other two children to CPS. We're considering the offer, as we've looking into adoption for a long time but this seems like a much easier, more affordable option and this is a local child in need of a loving family. I understand that with guardianship, the birth mother can gain custody back should she want it, after proving herself fit. Perhaps she could terminate her rights in addition to giving us guardianship? If she does, could she still contest custody in the future? What if she were to hire a lawyer who says she was high or mentally unfit to make such a decision when she signed the papers?
I'd like to receive guardianship now and save up money for an attorney, adoption fees, etc. for a little while. I'm just so afraid that we'll fall in love with this little girl and she'll grow attached to us, only to be taken away from us later on. I'm not insensitive to this child's emotions and I'm aware that it would be a long hard road for her to adjust to us - but for our sanity and hers, we could only agree to take this child if we knew she would remain in our care.

She can terminate her rights through adoption, if and when that time comes for adoption.
