    Does the Defendant Have to Request a Copy of the Complaint
    My question involves business law in the state of: New york

    I got a summons with notice and I hadn't asked for the complaint yet. I know you have a certain amount of time to to respond and demand the complaint. Instead of me asking for the complaint the defendant sent me the complaint? Is that proper procedure? I though I have to ask for the complaint instead of them just mailing it to me?

    The court sends you the summons and complaint.

    Speaking very broadly.... in a small claims case, a court may provide for service. In a regular trial court service is normally the responsibility of the party. Service should include both the summons and complaint.

    As mentioned previously, service should include the Summons and Complaint. Court rules and state laws determine whether service is the responsibility of the party filing the action or the court.

    Oddly, the OP does not say what type of case this is ... I cannot comment w/o further details.
