    Collection of Student Loans Borrowed in Europe
    Hi Folks,

    I need some advise regarding a Foreign/Scandinavian student loan debt collection in US.

    In 1993 I took a loan in Sweden as new immigrant which they will allow the immigrants to borrow money to furnish their new apartments.
    Now, after 22 years and after moving to the states 12 years ago and becoming a US Citizen, the debt was sold or handed over to a US partner.

    I just got a debt collection letter asking me to pay the due amount.

    What are my options here, What can this collector do with debt?
    Do I have a statue limitation?
    Can the collector sue me?

    Please advise and Thank you.

    You can ignore it, appear in court to dispute it or you can pay it.

    Do NOT contact the debt collector at this point in time and do not pay a dime (as that would re-start the SOL if there is an issue there).

    This may involve 2 or 3 SOLs (Sweden & US/state).

    If I don't know a better answer, I'll tell ya ... and I don't have a better answer than what is above.

    Of course, you should have paid your dang bill long ago....

    You will need to explore the validity of the debt in the nation in which you borrowed the debt and, if it is no longer subject to collection, raise that as a defense to any collection action in the U.S.

    The laws of the U.S. state involved may be relevant to any collection effort, should they sue.

    If all we're talking about is a letter from a debt collector, they may not care about whether or not they can successfully sue. If that were the case and if it were me, I would instruct the collection agency to cease all contact with me as a suit seems unlikely.

    I agree that the state you live in makes a lot of difference. In NC a contract can only be enforced thru the courts for 3 years from the date of default. NY I think is 7 years. If you have been here for 12 years there are very few states that would allow the enforcement of the original contract you signed 22 years ago thru a 3rd party that purchased the debt. If you are sued you can raise the statute of limitations defense but no matter what you do don't send them a dime. If you send them a penny you are reaffirming the debt and then you got problems for real!!! Also I don't know if you can be held responsible for something that happened before you were a U.S. Citizen. It is a very unusual problem for sure.
