    Duration of Firearm Surrender After a DV Case
    My question involves criminal law for the state of: CA
    Hello I have a question I'm very confused about right now, I had a DV charge that was dropped about a year ago and the firearm surrender was dropped. I am now in the process of becoming an Leo and my gf said she remember my attorney say I had a 10 year weapon ban that I can't be near weapons. I thought she was confusing that for the firearm surrender that is mandatory with a DV case. Do judges ever do this 10 year weapons surrender or is my gf just confused? Thanks for any info

    And the only prior I had before the DV was a misdomeaner assault case

    Have you been CONVICTED of any criminal offense? If so, what was the code section? Was it a "domestic violence" related case?

    A "dropped" case should not result in a firearm ban ... but, there may be a restraining order or a protective order in place, still.

    I think you'd better consult an attorney who specializes in firearms law (likely plenty of them in AC) and stop taking legal advice from your girlfriend.

    Went into the courthouse and checked this morning, it expires in a month.

    WHAT expires? The TRO? The ten years since your conviction? What?

    Well after the DV was dropped I was ordered to complete some anger management classes, so when they are done the surrender expires

    Then there is some sort of TRO or other court order still in place. There is no such animal that I know of as a "surrender" unless it is attached to the TRO/CPO.

    It's been confusing trying to figure out all the details I may need to pay another visit to the courthouse
