Suit Affecting Parent Child Relationship of Nephew
My question involves a child custody case from the State of: Texas
My husband and I are trying to get conservatorship of my husbands nephew. The parents of the child have not seen/spoken to the child in months, he is living with us. The parents have already signed an Authorization Agreement for Non-Parent Relative signed by both parents. We have filed a petition for Suit Affecting Parent Child Relationship (SAPCR) agreed case, the parents have signed the waivers. However, when I went to the courthouse to get a court date the clerk spoke with the judge and suggested I get legal representation.
I have done lots of research and thought because it was an agreed case that it should be fairly easy. The Texaslawhelp.org website had all the paperwork and brochures. Is there anything else I might need to file?
I guess my question is... if it is an agreed case, what could go wrong? Could the judge say "No" even though the parents are un-fit and have not been supporting their own child for nearly a year? Is there other paperwork I can file with it to terminate the parents rights'?
