    Error in Child Support Order
    My question involves a child custody case from the State of: MISSOURI
    Here is the judgment, can someone please clarify it.
    Thank you

    NO MAINTENANCE TO BE PAID TO PET BY RES
    SAID ORDER NOT SUBJECT TO MODIFICATION
    PET ORDERED TO PAY RES THE SUM OF $500 PER MONTH AS AND FOR MAINTENANCE, SAID ORDER NOT SUBJECT TO MODIFICATION
    WIFE GRANTED RESTORATION OF HER MAIDEN NAME OF "JANE DOE"
    SOLE LEGAL CUSTODY TO MOTHER
    SOLE PHYSICAL CUSTODY TO MOTHER
    AND VISITATION TO FATHER
    FATHER SHALL NOT REMOVE THE CHILDREN FROM THE USA W/OUT MOTHER'S WRITTEN CONSENT
    MOTHER SHALL HOLD CHILDRENS PASSPORTS
    RES SHALL PAY TO PET THE SUM OF $768 PER MONTH
    AS AND FOR CHILD SUPPORT FIRST PMT DUE ON DATE OF ENTRY OF JUDGMENT
    PARENTING PLAN, FILED AS EXHIBIT 1 FORM 14,
    FILED MARITAL SETTLEMENT AGREEMENT,
    FILED AS EXHIBIT 2 REFER TO JUDGMENT FOR ADDT'L ORDERS CC HANDED TO APLT CC MAILED TO A RES (8/2/13) SO ORDERED

    It sounds like there is a mistake in the order. The order gives you sole legal and physical custody, but orders you to pay 768.00 per month in child support to your ex-husband. That obviously isn't correct.

    Do you have an attorney?

    It isn't completely unheard of for the CP to pay support to the NCP but I agree with LL. Sole physical custody to mom with visitation to father and mom pays CS, yet husband has been ordered to pay spousal support in amount of $500 per month?

    Mom, is there a huge discrepancy between your income and dad's? Do you make substantially more? What is the timeshare in your parenting plan? How much visitation does dad have?

    The line about spousal support not being modifiable is also unusual.

    And to echo LL's question - do you have an attorney?

    This is the part that does not make any sense to me either. I do not have a lawyer at this time.

    It looks like you are going to need one to get this fixed. You need to jump on this immediately.

    Do you know WHO wrote this order? Does your ex have an attorney?
