Can a Court Tell You Where Not to Go
My question involves criminal law for the state of: NC
My daughter has a pending court case in NC. We live in VA. The lawyer told us the charges will be dismissed in a few weeks. My daughter got in trouble at school, out of state, hence the court case. She has not been at that school since the case but she wants to return. My question is, can the NC court tell her that she cannot go to NC attend school anymore? They have not monitored her at all, especially not her movements since her arrest, as she recently went on a West Coast trip for a month, but I was wondered when the charges are dismissed, can courts ban her from any particular area?

The court can absolutely restrain her from area X.

banishment is unconstitutional, they cannot ban her from entering the state. the SCHOOL can certainly expell her and ban her from campus, and an individual at the school could get a restraining order that effectively bans her from campus for the duration the other person is attending.

The COURT can restrict her if the school obtains a RO ;)

Of course, but if the charges are being dismissed I am not sure why the school would.

The standard conditions of being released on a bail bond or pretrial release is that the defendant cannot cross state lines without the court's permission.
