Assault After Objecting to Being Cut Off

My question involves criminal law for the state of: Florida

My mother was at a BJs gas station yesterday, waiting in line to get gas when an SUV pulls up and cuts her place in line, when my mother decided to complain to them about it and she got knocked down to the ground by one of them and had to be hospitalized. My mother is very delicate and old, she is a cancer survivor who just had a major brain surgery and is in very delicate health. these ladies who attacked her were strong large rugged Butch females with bad attitudes. She suffered an injury to the eye and has loss of vision and headaches. We are still monitoring her to see if there is going to be any long term effects. She had to get a cat scan, and her prescription glasses were broken. We don't know who these people are. We have a FL license plate number 800XUB. There was a BJs security guard who just sat there watching the whole thing and didnt do anything to help out! BJs has video camera footage of the whole thing. I asked them to find out who these people are and to cancel their membership and have not received a response. I need to know what I can do... I can handle a lot in life, but when it comes to my mother, thats where I draw the line. My mother is sacred to me. She has been through so much and how dare they put their nasty hands on her. I will not sit here with my arms crossed while these Nasty Dikes continue to roam free. I need justice! They are lucky that I wasnt there. These medical expenses are not something to be shrugged off. Please, someone guide me through this. Thank you.

has anybody bothered to make a police report? It would have been prudent to do it before your mother left the scene.

Yes a police report has been filed. I dont know if thats going to be enough... They arrived on scene and took a report and left. No arrests were made. I hope they have time for this. Nothing happend we took my mom to the hospital to get checked out and ordered a cat scan. She is having a sharp pain in one of her eyes and she says her vision gets fuzzy with each heart palpitation. We still dont know what the long term effects are going to be.

she needs to follow up with the police to see if they are referring it to the prosecutor for review. If it is passed along, she can call the prosecutor to see what any actions might be.

the rest is civil in nature. You can ask bj's about the video but unless there is a court order restricting them from deleting it, they have no obligation to retain it or turn it over to you.

Yes, we have one witness who left a phone number... the problem is that we dont have a name of the attacker, just a license plate number and it was the passenger of that vehicule who threw the punch. I dont know if the police will be able to get to the bottom of this.

That is why mom needs to contact the police and ask them what the status of the investigation might be. If they have a license plate number, that might get them to the registered owner of the car, but that might not be sufficient to force the registered owner to admit to anything or say who was in the car at the time of the incident. If they can, perhaps the police can make a photo lineup to include a DMV photo of the registered owner and any other drivers in the household and show it to mom ... whether that will happen or be enough to pursue a prosecution, who can say?

With luck, the police have a copy of the video.

When you talk to the police, don't mention they are "dikes". For one, you are profiling, for a second, you don't know if they lesbians or not...so just makes you look like you have an issued with potential lesbians, ok?

Im sorry but I refuse to live in a society where one has to be apologetic to peoples grotesque life decisions, my mother had every right to stand up herself non violently and they had no right to attack. You might be able to take the high road and live like a coward, but not my mother. You are right though, I do not know if they are gay and I do not care. All I know is that These women were so ugly they looked, dressed and acted like men. In my humble opinion, If they want to be out there acting like Men then they need to respond to their actions like a MAN. Your sensitivity is none of my concern. Nobody hits my mother. PERIOD.

No one hits my mom either....but I don't automatically label them as "Fat Dykes".

If the case goes to court....it may label your mom as the aggressor and work against her.

By the way...I'm not a coward. You have to learn when to pick and choose which battle to wage. I've won every single one I have waged...without bringing race, sex, etc., into it. Believe me, I can be the nicest person you will ever meet....mess with me, I can be your worst enemy :)

I'm just saying...go to court and say "fat dykes"....the judge is going to see you as having a Discriminatory attitude.

and really...it is up to your mom and witnesses to testify as to what happened.

Except that you have no knowledge whatsoever of what "life decisions" those women made! Should we refer to you as a "redneck lout?" You have no more knowledge of their life choices than I do of yours.

And, as mentioned, referring to the women as "dikes" to the police will likely put them off and you may find that they suddenly find themselves less interested in helping your mom out. If you hold these opinions, it might be best to keep them to yourself so as to avoid interfering with your mom's case.

Then let the police do their job. If YOU stick your nose into this all you may do is serve to alienate the investigators. An elderly woman is a sympathetic victim ... their loudmouth overly-opinionated child only serves to diminish that sympathy.

This isn't your forum. They should behave in public, and so should you.

It's not about being "righteous," but it is about doing what is best for your mother. Ranting to the police - or even to the business - will do nothing to further your mother's case.

Hopefully the video will affirm your mother's account of events and help the police track down her attackers.

And this piece of you-know-what is your apology??? What's wrong with you? Nobody said they didn't sympathize with your Mom, nobody was rude to you, all people did was answer your questions and make suggestions that would help you in your endeavour to get justice for your Mom. Know what, dude? My mom uses a cane. Because of botched surgery, ANY FALL CAN KILL HER.

Last month...she was taking her dog for a short walk. Another dog was running lose and mom's dog panicked and ran, and my mom fell to the ground. Had my mother let me...I wanted to go and simply tell them what happened, and to please keep their dog on a leash or in the yard, per the law. No insults, no threats.

By the way, what is your definition of dressing like a man? When I worked as a Route Merchandiser, after my first week, I started wearing baggy shorts or jean shorts and a tank top, hair in ponytail, no makeup. I was lifting 40-lb boxes all day. Does that make me a dyke?
