Custody of My Little Brother Without Actually Being in the State
My question involves a child custody case from the State of: Indiana
I am a soldier on Fort Hood and my little brother lives back in Indiana. My older brother is going to Virginia for college and my younger brother is moving to east Indiana. My mom has agreed to give me custody of my little brother so that I may help him get his life back on track. I do not have the time right now to go to Indiana or the money i can exactly spend to go. Can i gain custody of him without physically being in Indiana? If I can then I have already found an apartment and a school for him, as well as a tutor to help him out which is myself. Just avoiding spending the extra money that is not necessary.

Are there any custody orders in place at the moment? Is the State of Indiana involved in any way (CPS or state aid)? Where is Dad, and why on earth would Mom shrug her responsiblities? Since you are active duty, how on earth do you think you will be able to monitor this young boy and still fulfill your duties?

Tigi...unless he is deployed being on active duty is no different than having a full time job. However, yes, whether or not CPS is involved, and the whereabouts of the father, whether there are custody orders currently in place are important issues.
However, if dad is deceased or otherwise completely out of the picture its fairly easy for mom and older son to draw up a joint stipulation for the older son to have temporary custody and to submit it to the court for signature.

Well if you must know, we havent really seen our father since we were young. He's a pill addict and an alcoholic. My mother and I see it best if he's here with me because he wont listen to my mother. He will listen to me however, because he knows what ive been thru and im the only person trying to help him. Active duty is no issue to having him here with me, and if you see that as an issue then to bad. Please do not talk down about me being able to handle my responsibilities in the military or my brother. It's upsetting that youd actually think that an Active Duty personnel can't handle that responsibility. Nothing is in place yet because I need to know if I have to be in the state or if they can fax the paperwork for me to sign it. Please let me know. Thank you.

My questions are valid questions. I misworded my question with regards to you being active duty, I didn't mean it as a slam but I do see how it came off that way- forgive me.
We need to know if the State of Indiana is involved with your brother in any way. Also are there any current court orders in place. For example if there is a court order and your father has joint custody, this may be more difficult for you to accomplish. If the State is involved and you retain custody of your brother, you should know that your mother may have to pay the State for any aid they are supplying to your brother.
There are many cogs in the wheel here that are turning, it isn't just a simple yes or no answer.

Its fine. My father has no form of custody with him, my mom has 100%. The state has no court orders on him either. He just got off of probation, but thats about it. I know anything you need to know really. I keep track of him because I do not want him to travel the dark path of his friends and peers.

Does your mom get any state aid for him, like food stamps, cash, health insurance?

I think she gets food stamps still. As far as health insurance he is on Medicaid or something like that.

If I remember Indiana has very specific laws regarding custody and LL would know better but since your mother and brother are state aide recepients, this could be problematic. If you take legal custody of your brother, you mom might be liable to the State for the costs they incur for his care like continued medical care.

If his brother gets actual custody and the child becomes his dependent Medicaid won't be needed any longer. Indiana Medicaid also wouldn't be usable outside of Indiana anyway.
This really should be a fairly simple matter legally. If you could at least afford an attorney to draw up a joint stipulation and file it with the courts, its unlikely that anyone would have to attend court even.
If you do not use an attorney it gets a bit more complicated, but its still doable and you might not have to attend court. Your mother definitely would have to attend, but you might not have to.
