Can Permanent Residency Be Revoked
My husband just gained permanent residency through Ciudad Juarez, MX this year after waiting seven months for a waiver approval. When he first entered this country he used a different name. He had a daughter with another woman and she took out child support and ordered a paternity test on him. He went through this process using the wrong name. Now, he wants to put the correct name on his daughter's birth certificate so he can take responsibility for her and fight for visitation. (The mother refuses visitation).
The problem is he didn't tell the consulate at his interview that he used a different name when he first entered the country. (It was his brother's name.) Does anyone know the chances of this getting back to immigration since he is now a permanent resident? He wants to make this "right", but he fears that he will jeopardize his status if he does.
Any info would be appreciated.

What you're stating is that he had a period of illegal presence in the U.S. premised upon his assuming a false ID and misrepresenting his identity to immigration authorities, which may result in his being subject to deportation. He should consult an immigration lawyer.

Well, his illegal presence was for EWI. He never assumed another ID to get into the country or to immigration authorities. He only used his brother's name after getting here for a couple of years, then used his real name.
The only way for it to get back to immigration now, is if he admits this to the courts inorder to receive visitation and parental rights of his daughter. I just don't know if the courts will report this to immigration. I was told that a permanent resident card can be revoke, but it's for major crimes and felonies. I guess you are right, I should consult with a specialist before we make any major decisions.

I have never known a family court to report something like this to immigration - they probably won't even know that it's an issue - but his ex- might.

Thanks. I didn't think the court would really waste time with this either. Especially since he is trying to make it "right" and take responsibilty. Someone that works at a Child Support in a different state than mine said that this happens alot. I would guess the best thing for him to do is to speak with his child support agent and take the necessary steps. Then, he can take action to get visitation rights.
