    Can I Sue the U.S. Consulate for Not Moving Faster on My Visa Application
    my case ended in USCIS and now with NVC. Every time I call they say they are trying to schedule interview with consulate in india, this has been from two months. Whenever I call to them they keep telling same since two months. They dont have exact time, are they doing because of my ethicity dont know. Now I am tired of calling them I have no response from them. Please guide what to do, do i need to hire lawyer and sue NVC ...... Please help me

    Your case is only one of many.They are certainly not doing it because of your ethnicity; you need to get that chip off of your shoulder tight now; your attitude is not appreciated.

    You have no grounds to sue them. You may certainly want to hire an attorney to review your case to determine if you have failed to file properly or to identify any issues that might be the cause of the delay. You need to understand that no one - even you - is guaranteed a visa.

    Can you please anyone explain what I got email from NVC below. Why they are taking this much of time for me


    "The National Visa Center has received all documentation necessary to complete pre-processing
    of your case. As soon as an interview date has been scheduled, the applicant, petitioner
    and attorney (if applicable) will be notified.

    The applicant should NOT make any travel arrangements, sell property, or give up employment
    until the US Embassy or Consulate General has issued a visa."

    You got that letter because they send applicants standard form letters.

    They are taking however much time they are taking, because that's how long its taking to process your case.

    i have read all blogs, in forums maximum time to schedule for interview is 6 weeks mine more than 8 weeks and they are not saying is any thing wrong. All the time they saying we are scheduling interview and they are not receiving response from consulate from India

    Just because the average time is a maximum of 6 weeks does not mean that you are guaranteed and entitled by law to no more than 6 weeks. Your turn will come up when it comes.

    Then it appears the delay and problems are occurring in India. US government officials have no power to make Indian officials do anything any faster.

    The U.S. consulate in India is not part of the government of India. ;)

    They will advise you when it your time for an interview, you will receive a letter.

    You can talk to whomever you would like. If they're in a position to answer your questions, odds are they're tell you what you already know - that your case is being processed and that you need to be patient.
