Temporary Work and Not Waiting 3 Business Days
My question involves unemployment benefits for the state of: TX
I worked as a temporary employee for 2 years and 7 months at the same state office. This is a federally funded position and a certain company is awarded the funds every 2 fiscal years, so the job was expected to last until 8/31/13 and for 2 more years if congress approved more funding. I was unexpectedly told that "you are no longer working at such and such agency and please do not go to work Monday". I don't know why. I was an amazing employee. I know that the temp agency will not have a problem agreeing I should get uib. But, I'm confused. It wasn't what you call a traditional temp agency, so should I have waited 3 business days? I didn't-I waited 3 calendar days which is what I thought it was. When I was hired, I filled out an application specifically for this position and even put the title of the position applying for on it, was never told to call and report to them if I was let go, and was not ever told they would have any assignments. As far as I know, there aren't any other assignments in my town with them. This was not a "traditional" temp job where you get put on short term assignments. I was hired specifically for this position and this position alone. So, did I mess up by applying too soon? I'm waiting and waiting for a decision still...Any input or anyone else been in this situation?
Re: Temporary Work and Not Waiting 3 Business Days
Did you apply online or using online access to TWC? Even though you might not have received anything by mail, TWC does show incomplete blurbs as to the status and reason for the decision. That's the first clue to be watching your mailbox.
I don't know how the 3-day rule will affect you, but you do have other issues that would take time to sort out. You were discharged, it appears you didn't advise the agency of your availability, and you didn't wait 3-days.
Until you get a determination, there's nothing you can really do except to keep filing your weekly claims. If you receive a decision that is adverse to you, it'll tell you why and you can appeal it.
Re: Temporary Work and Not Waiting 3 Business Days
I did contact them. It's just that I filed UI on Saturday before I contacted them on Monday. When my job assignment ended, my employment also ended at the same time with the temp agency, which is not really a traditional temp agency. It really could be described more accurately as contract work and my paycheck actually has them listed as "such and such contract services inc", so I may be incorrect in thinking they are a temp agency.
When I filled out my application, new hire paperwork etc nothing was ever said to me about contacting them for other jobs or assignments. If this one ended, it was over. When I did contact them, because I thought it would be a good idea, their response was that they were kinda confused about why I was even calling them. If I want to work at any future contracted employers they have, I have to apply for it and interview competitively as if I am a new employee for them.
So, it's a little different.

Who specifically told you that you no longer worked for the agency and not to go to work on Monday? Did you contact the client you were working for an ask them what they knew about this?
I am concerned that you got caught up in a struggle between the agency and their client, and might have had a job directly with the client had you shown up for work on Monday.

No, that is not the situation at all.

How do I cancel this account? The advice I'm getting is ridiculous.

That's pretty harsh. You haven't even been denied benefits yet, and you're speculating as to the reason why.
You've also got some not so clearcut things at work here. Were you working through a staff agency as defined by TWC? No one really knows. You say you don't think so, but that's not your call to make.
Re: Temporary Work and Not Waiting 3 Business Days
I really want to cancel this account...but I can't seem to find a way to!!! Very frustrating.

You dry up and blow away. Seriously, why are you being such an ass?

I'm going to tell my mom! She won't like that language. I'm 12 and I was trying to help my mom out, but never mind...mean people :(

Okay, you're obnoxious and you're a liar. Thanks for clearing that up.
If you do have a 12-year-old child, I feel sorry for a kid stuck with a parent like you.

Go to bed little girl. Its past your bed time. Let the adults handle adult matters. You do not have a clue.
