If an Employee Helps a Friend Steal, Can They Both Be Charged
A friend of mine is being charged with Employee theft. He apparently gave over 10+ discounts to friends and family while working. My question is can his family or friends be charged also? Especially if they paid for some items with card.....and what will happen with his case?
Re: Can Friends Be Charged (Employee Theft)
They were involved in a theft conspiracy. Of course they can be charged.
Re: Can Friends Be Charged (Employee Theft)
It depends on the circumstances. If it was just a discount as in, 10% off, not likely. If it was a 100% discount or they were willingly participating in the thefts, maybe. Knowing the state, which is asked for for a reason, would help.
I used to work LP. I can count on two hands the number of times I went after the people getting unauthorized discounts from an employee. It was not as easy to get law enforcement to go after those cases as it was a straight-up giveaway.

The store your friend works at....what is their policy for discounts?
Re: Can Friends Be Charged (Employee Theft)
As has already been said, more info is needed to give a complete answer. However, it is likely going to boil down to one thing: Did the “friends and family” know or should have known (ie., would a reasonable person have had at least a strong suspicion) that your friend was not authorized to give the “discounts?” If the answer is “yes,” then, yes, they were active accomplices in your friend’s theft and can be equally charged – and should be.
Re: Can Friends Be Charged (Employee Theft)
He gave the items nearly 100% off. He did it over 10 times with family and friends. He was taken in Wednesday and let out yesterday. He has court in exactly 1 month. Can anyone be found to get dragged into court with him? What kind of investigation is there when it's a Employee theft such as this? I'm curious since they are getting him for all the unauthorized transactions, is it worth it for them to get everyone involved or pin it on him because he worked there is more serious?

Miss Cleo doesn't post here and my crystal ball is in the shop.
But yes they could be charged as well.
Re: Can Friends Be Charged (Employee Theft)
A nearly 100% discount? I would expect his charges to be quite serious. And yes, he will be fired, he will not collect Unemployment. And yes, an almost "free" item - they can see who he sold the items to......
Re: Can Friends Be Charged (Employee Theft)
I don't know how to make it any more clear than this.
Yes, the others CAN be charged. We do not have any way of knowing whether they WILL be charged.
You're just going to have to wait and see.

If charged, pretty easy to defend. "I didn't know how much he charged me, I just swiped my card! I had plenty of money to purchase them at full price."
Most companies seek restitution from the employee. Don't people realize everything with a number can be tracked?
