    Traffic Ticket for Running a Red Light Which I Did Not Commit
    My question involves a Red light traffic ticket from the state of California: I was driving from Aliso Viejo to Citibank located on 24221 Calle De La Louisa Laguna Hills, CA 92653 on Friday July 5, 2013 at around 9:30pm. When I pulled into the Citibank parking lot a Laguna Hills Police officer pulled in behind me and put on his police lights. There were 2 cops. One cop named J. Amora (who appeared to be in training from the other cop) came up to my car with my girlfriend and I in it and asked for my license and registration. J Amora asked why I was in such a hurry and I said I was just heading to the Citibank to make a deposit. J Amora then asked me "DID I DRIVE THRU A RED LIGHT". I said "what?" "Absolutely not". He then asked again back on Paseo De Valencia did you go thru a red light" I once again said "absolutely not and my girlfriend also stated that we did not drive thru ANY red lights". J Amora went back to his car and spoke with the other officer. Both Police officers came back to my car and J. Amore handed me a RED LIGHT TICKET. I said what is this? And they explained that it was a red light ticket and I needed to sign it. My girlfriend and I both then told the officers "We just explained to you that we did not go thru any red lights, what is going on here" The officer said that I must the sign the ticket. I said “I will sign the ticket but would like the Police Supervisor called to the scene.” At that point the office reached into my car and put one handcuff on me. My girlfriend and I were stunned and started saying "WHAT ARE YOU DOING". The other officer (NOT J. Amora" stated you are not signing the ticket so we will need to arrest you.” I stated "WHAT" "I just told you that I would sign the ticket but wanted a Supervisor called to the scene". That officer then stated you need to sign the ticket now and no supervisor will be coming out." "We started arguing and he said everything is caught on our video camera. I said GREAT lets see the video then. He said “in court”. He made me sign the ticket twice because the first time I signed it he said it did not look my signature. I also wrote on the ticket “DO NOT AGREE”. They left me with the ticket. I then called the Laguna Hills Police Supervisor last name PRINCE" I told him the story and that I wanted him to review the video, that he will not see us driving thru any red lights. He said he does not review the videos for driving infractions. I then called the Sheriff’s WATCH COMANDER for Orange county (Lieutentant Dwyer) under advice from a friend who is a Sergeant in San Juan Capistrano. The watch commander listened to what I had say, we argued a few points. I told him that he has a corrupt officer on his force. He said maybe the officer made a mistake and then tried to tell me it will be reviewed in court. I once again made my point very clear that there is no way we drove thru a RED LIGHT and there is no video of such incident. I told him if he watches the video and finds that I drove thru a red light I would pay the ticket and not dispute it BUT he will not find such a video, as it never occurred. He once again told me that MAYBE the police officer "Made a MISTAKE" and that he would call me back on Monday. Well today is Monday at 10:31pm and I never received a call. I called the Orange county Sherriff’s department and Watch commander Dwyer does not work again until Wednesday (tonight)! I have a clean record with DMV. I told my friend the San Juan Capistrano Sergeant about what is happening again and he said “I think if you feel like you were treated unfairly you have the right to complain If your not being contacted then go to the LH city hall tomorrow I bet once you ask to speak with the city manager someone will call you back.”

    What do I do?

    Appear in court, plead not guilty and go to trial. Tell the judge you did not run the light. The officer will testify you did and you will be found guilty. You can always subpoena his statement and any video. You can have you GF testify on your behalf though it likely will mean nothing.

    Traffic citations are not decided on the side of the road, they are not disputed with the citing officer's supervisor, they are not decided by complaining to Watch commander nor the County Sheriff. Lastly, I am not sure what you are expecting anyone at city hall to tell you or do for you.

    If you would have taken the time to read the short line above the space where you are required to sign, you would see that it says:

    "WITHOUT ADMITTING GUILT, I PROMISE TO APPEAR AT THE TIME AND PLACE INDICATED BELOW"

    That is the only way to contest the citation if you want to contest it. You go to court, plead not guilty and request a trial like every other driver.

    Having a clean record does not mean you are immune to running a red light. And for your information, a police cruiser recorder is not on record the entire time. It is typically activated if the officer wants it to be on otherwise it automatically comes on when the emergency lights come on. So the fact that you will not find a recording of you running a red light is not proof that you did not run a red light. It simply means the camera was not recording and at the time, there was no reason for it to be recording... its not like the officer knew you were going to run the light.

    Last but not least, let us assume that one officer is corrupt, that he would out of the blue and for no apparent reason whatsoever decide to pull you over and cite you for an infraction that you didn't commit... What about the second office? Is he corrupt too?

    You are free to file a complaint. But no matter who you file it with or who you file it about, understand that it will have ZERO impact on the validity or outcome of your citation.

    OP, you might also want to check out PARAGRAPHS AND WHEN TO USE THEM. Your post gave me a headache just trying to read it.
