My question involves criminal law for the state of: florida
Ok i'm 20 years old my gf is 16 soon to be 17 , We had sex and she is now pregnant , We are scared to tell her mom because we are not sure if she can put me in jail or not . We are going to stay together marry and take care of the kid . I have a house a car and a really good job . But her mom is crazy. Can someone please help me out here and clarify things .
What all can happen if she wants to press charges.
Florida's Romeo and Juliet laws will prevent her from having you thrown in jail for having sex with her daughter. That does NOT mean that there is nothing that can happen to you. Your gf CANNOT be married, pregnant or not, without permission from her parents, permission from the court, or both. The chances that a court will override her mother's wishes and allow her 16 year old daughter to be married against the parents wishes are slim, at best.
What is more likely to happen is that Mom (and sorry, but I don't think it's crazy for Mom to be upset with her 16 year old daughter having sex with a 20 year old) will tell you to stay the he** away from her daughter, and yes, legally she CAN make that stick. Mom is GOD until her daughter is 18. Being pregnant does NOT change that. If you do not follow Mom's rules about when, where, and even IF you can see her, Mom can apply for a restraining order. And if she gets one and you violate it, THEN you go to jail.
So my suggestion to you is to make very, very nice with Mom, because the law is on her side, not yours.
And, obviously, the time to think about whether your pecker's activities could result in jail time is BEFORE you use it on a minor. Write that down. It's REALLY important.

Understand this: You have ZERO right to see your girlfriend. Your failure to use contraceptives does not give you an opportunity to do an end run around Mom's authority. Expect to be told to back the hell off. Expect that when you two do your song and dance about twue wuv, Mom will get the courts involved to FORCE you to stay away from her daughter. When she gives birth, you are NOT entitled to be present.
Once the child is born, you may establish paternity, seek custody and visitation orders, and get child support set up, but that STILL won't entitle you to see your girlfriend. That may well be off the table til she's 18.
Thanks everyone , yes I understand what yall mean about my age and everything. Here is some info i didn't give yall which made me look really bad. First her mom never knew I was told her age when I found out she was pregnant I meet her at a bar out where I live . Which you have to be 18 to get in so I thought everything was good. We have been dating for two weeks been seeing each other for about a month in a half . She now tells me she got into the bar because she knows the bar owners . I didn't ever consider age she was in a bar had a nice car and told me some more lies. Yes She lied but Im here for my kid . If its mine of course . Sorry to make seem like im a bad guy .
Sorry, pal, but that doesn't do anything at all to change the answers. It is stupid, stupid, stupid to have sex with someone unless you have known them long enough to know, and not just assume, such basic things as age. You're still not just the bad guy, but a stupid bad guy, in my book.
